Can a felony conviction by a sponsor affect the person being sponsored? If they get deported will it result in any punitive action against the person being sponsored? Is there a time limit where a sponsor can't affect the person being sponsored by committing a crime?

I went for H1B stamping, but i know a friend of mine went for F1 (PhD) extension and had to go through the same process. I called Dept. of State multiple times, dont expect a polite response. They may even say it may take years. Thats what they told me the day before i got the visa. Dont worry your wife will get the visa eventually. Tell her to enjoy India in the mean time like i did on my forced vacation.

i have birth certificate which is taken in 2005 but I was born in 1974
some of my friends are saying...as you are born in 1974 and as your
birth certificate was taken in yr 2005, it might cause problems (ins poseses query)
to get the green card.
Is it right?
They are saying me to get Affidivits + non availability certificate now.
will it be a problem if I put my birth certificate....while applying for 485

My advise is to get a Non-availability of birth certificate because an RFE is the last thing you wanna see. My wife tried Allied Legal, India to get Non-availability of birth certificate for her parents. you can try them. They are the immigration attorneys in USA. I'm currently working for Company A on H1B Visa. My GC is sponsored through Company B as a future employee. I never worked for Company B which has sponsored for my GC. I have applied for I485 and I140 has been approved for more than 6 months.
Company A is going through lay offs and wont be able to apply for my GC. My 6 yr limit on H1B from Company A will expire next year.
Can i apply for H1B extension through Company A based on my I-140 from Company B.

wanted to see the timeline of EAD renewals currently..I have a EAD renewal receipt notice date of June 18th......was wondering how many days is TX taking to approve the notice....
Did aanyone around June 15 -June 20th get any approval yet?
Isn't it too soon to expect it? They usually take 45 to 60 days. It has been only a couple of weeks.

I agree there isn't much to look at though, nice colors and sun, but no foreground interest.
Try cutting the top half off, just above the two darker long clouds, would make it much more dramatic.

I will fell more comfortable if the experience letter mentions the last day as 5/17/2009. Otherwise I will simply mention it as April 2009. This way the continuous employment criteria will be met.

My EB3 � India, I-485 application is pending and I am planning to explore options of porting to EB2.
I am currently working with another employer (B) different from the GC sponsoring company (A) using AC-21 rule.
My current employer (B) is planning to apply for labor in EB2 category.
The job requirements satisfy EB2 eligibility and I have the skills/qualifications for the EB2 category before I joined the current employer (B) (in fact even before joining the employer A).
Two questions:
1). Do you see any problem with the above scenario?
2). If you are not a lawyer, can you please suggest a good immigration lawyer that is very good at dealing with porting.

I have sent the request for renewal of my and my wife's advance parole to the USCIS about 10 days back.
Following is the list of documents that I have sent, along with a fees of $360, online (each)
- Copy of the Confirmation Receipt notice.
- Copy of I-485 petition.
- Current Status of I-485: Case received and pending.
- Copy of I-94.
- Copy of current approved I-512L, authorization for Parole of an Alien Into the United States.
- Copy of Passport.
- Two photographs.
- Copy of Drivers License.
Do I need to send any fingerprinting document?
Is there anything else that I need to take care of related to this request for advance parole renewal?

Hi,
Although my EAD has been approved long back, I haven't actually received the actual EAD card in hand because of an address related glitch. It is said they will re-send, but the delay is unbelievable. I have the A# from other correspondences.
Under the circumstances, can I apply for a AC21.

Have you heard of eVerify? Anybody can explain what it is?
My H1 expired 6 months ago and my current EAD expires October 20th. I filed for renewal application on July01 and am a little concerned that I will not get my new one within the 90 day window.
I called USCIS and a Customer Service rep mentioned that I do not need an EAD to legally work as long as I am on AOS.
She also mentioned that as long as I have a valid Driver's License and a valid Social Security Number, I am fine and that I do not need a EAD.
Is this true? Has anyone else heard about / used this policy?

Please find below my case details:
i.Started on L1A in Dec 2001
ii.Applied for a new H1 in June 2005 with start date as Oct 1,2005(New H1 application) : Came to US on H1 in Mar 2006 with "I 94 and Petition End Date(PED)" as Dec 2007.
iii.Since Dec 2001 till Mar 2006, have been in India for totalling 10 months (2.5 months in 2003, 1.5 months 2004, 6 months during 2005-2006).
With the assumption that I can recapture the time spent outside US (10 months), the six year clock ends in Oct 2008. If so, to get 7th year extension
would it work as long as the Labour is filed before Oct 2007.
Am I correct in this assessment or does the 6 year clock indeed ends in "Dec 2007" (as in my I94/PED) and I should have the Labour filed before Dec 2006.
Any thoughts? Appreciate your comments.

you have enough time to get started with your labor. earlier the better. have your company start your labor in a couple of months so that do dont have to worry about all the nitty gritties of recapture of time. yes one can recapture the time with a petition. less legal work is less money paid and less headache in my opinion.
